Refund refused for unused subscription reported same day, despite EU 14-day right of withdrawal
I subscribed to ImagineArt Standard ($30/month) on April 27, 2026 by mistake — I was looking for a different AI tool and landed on their checkout accidentally. I requested a full refund the same day, minutes after the purchase, before using the service. My account dashboard shows 0 credits used out of 8,000 — the service was never rendered. What followed was a textbook delay tactic: my case was passed between three different agents (Fatima, Shahzaib, Suleman) over 10+ days, none of whom provided substantive responses. I was offered a partial refund of $21 (keeping $9 without justification), which I declined. EU Directive 2011/83 Article 9 grants a 14-day right of withdrawal for digital services, and Article 16(m) exception requires three cumulative conditions that ImagineArt did not meet (no explicit consent for waiver of withdrawal right). Article 25 confirms these rights cannot be contractually waived.
